A Sharia Court ll in Magajin Gari, Kaduna State, on Tuesday struck out a case of premises recovery filed by one Mr Ussaini Abdullahi, over lack of jurisdiction.
The Judge, Mr Murtala Nasir, struck out the case after the defendant, Mr Muhammad Abdullahi, through his counsel, Frank David, prayed the court to dismiss the case, saying the court lacked jurisdiction over the matter.
The counsel noted that section 5 subsection 4 of the Kaduna State Land and Tenants Law 2018, stated that recoveries of premises are under the jurisdiction of customary and district courts.
Earlier, the Complainant, Ussaini Abdullahi, told the court that Muhammad Abdullahi’s, a tenant in the apartment at Kabba Road, Kaduna, rent was due for renewal in December 2018, and he refused to renew it.
“When he was issued with court summon, he came with his mother and pleaded; he gave me N120,000 out of N250,000, which he pays yearly.
“I don’t want his money, I am praying the court to recover my premises,” Abdullahi said.
