Court adjourns case of alleged mischief, criminal conspiracy against Rector NCAT Zaria, others

The case of alleged mischief, criminal conspiracy and trespass, filed against Capt. Modibbo Mahmud, Rector, Nigeria College of Aviation Technology, (NCAT) Zaria, has been adjourned indefinitely.

The Rector is standing trial before the Chief Magistrate Court II, Kings Road, Sabon Gari Zaria.

Standing trial alongside the Rector are Malam Balarabe Mohammed, Public Relation Officer of the College; Ismaila Dikko, Director-General of Kaduna state Urban Planning and Development Agency (KASUPDA) and Yusuf Aliyu, Zonal Manager. KASUPDA, Zaria.

News Agency of Nigeria (NAN) recalls that on Jan. 5, the complainant, Malam Ahmed Yahaya approached the court seeking for a redress against the defendants over alleged conspiracy, criminal trespass and mischief.

He alleged that the defendants conspired to destroy his house at Unguwar Yusi (Graceland Area) in Sabon Gari Local Government Area, without following due process.

He said their action contravened the provisions of Section 59 of Kaduna state Penal Code Law 2017.

However, at the resumed hearing of the case, the Registrar of the court said there was an order from High Court number II, Zaria, directing the Magistrates Court to suspend its proceedings pending the determination of an application before High Court.

He further explained that the third and fourth defendants (KASUPDA) challenged the jurisdiction of the court to entertain the matter.

Mr Friday Ekeke, Counsel to the complainant, conceded to the order.

He however told the court apart from the fourth defendant, Balarabe Mohammed who is the Public Relations Officer of NCAT, the other defendants had not been coming to the court.

However, Andrew Akume, Counsel to the first and second defendants, said his clients had never shown any act of disrespect to the court.

Chief Magistrate, Mr Yakubu Badamasi, adjourned the matter sine die (indefinitely).
