An FCT High Court, Kubwa has fixed May 10 for the arraignment of four men charged with alleged armed robbery and culpable homicide.
The police is to arraign Aloysius Mbah, Chigozie Onuoha, Kingsley Ugo and Chizoba Nwafor with four counts bordering on criminal conspiracy and armed robbery.
Justice Bello Kawu fixed the date after the prosecution counsel, Bunmi Aimola, informed the court that the suspects do not have defence counsel.
“Going by the nature of the charge, Section 395 of the Administration of Criminal Justice Act (ACJA) states that if a defendant is charged with a capital offence without a defence counsel, the court should assign one,” Aimola said.
Following his submission, Justice Bello Kawu directed the court’s registrar to contact a counsel from the Legal Aid Council to represent the defendants.
Kawu did not take the plea of the suspects.
The police alleged that the suspects while armed with pump action rifles and live Cartridges and robbed, a businessman,Mr Kenneth Ndubuisi, of his cell phones, laptop and N500, 000 cash on Jan.26, 2020.
The prosecution counsel said the suspects also shot Christiana, Ndubuisi’s wife in the head which led to her death in Damagaza village, Apo.
