Court declares indictment of SSG by assembly illegal, null, of no effect

The decision of a woman to change her children’s school has become a subject of litigation between her and her husband.
The man, Yusuf Buhari, has filed a lawsuit against her, Hadiza Muhammad, at the Sharia Court sitting in Magajin Gari, Kaduna State.
The two children are females and Buhari also wants the woman to return them to his house.

According to reports, the court papers filed by his counsel, Sani Shehu, Mr Buhari claimed his estranged wife took his two female children to her parents’ house and changed their school from the one in which he had enrolled them without his consent.
Buhari also told the court that for six months, his estranged wife had refused to grant him access to see his children.

In her defence, the estranged wife, through her counsel, Adam Hassan, told the court that Islamic laws permitted a woman to take her children with her wherever she was going.

“If she is taking her children with her to a safe place, not a long distance from their father, it is allowed by law; even though they have little misunderstanding, she is still his wife,” the counsel said, while the judge, Murtala Nasir, adjourned the case till December 6.
