A 51-year-old bricklayer, Lawal Najimu, who unlawfully entered a plot of land and criminally damaged the fence valued at N 3.5 million, on Wednesday appeared in an Ikeja Chief Magistrates’ Court.
Najimu, who reside in No.4, Yisa Close, Ogunlana Owoyaya Street., Ibeju Lekki, is charged with six counts bordering on conspiracy, unlawful entry, wilful damage and breach of peace.
The Prosecution Counsel, Insp Mathew Akhaloude, told the court that the defendant conducted himself in a manner likely to cause a breach of peace by preventing the complainant, Mrs Stella Kamdikora, from gaining access to her plot of land.
Akhaloude told the court that the defendant with others, now at large, committed the offence in April at Orimedu Community, Ibeju Lekki, Lagos.
He alleged that the defendant also damaged a fence worth N3.5 million.
The defendant, he said, intended to cause reasonable apprehension of breach of peace by gaining access into the complainant’s piece of land.
The offence, he said, contravened the provisions of section 56 (1), 168, 350 and 411 of the Criminal Laws of Lagos State 2015, (Revised).
He pleaded not guilty to the charge.
The breach of peace stipulates six months jail term while wilful damage and conspiracy prescribe two years imprisonment for offenders.
Chief Magistrate A.A. Adetunji admitted the defendant to bail in the sum of N250,000 with two Sureties in like sum.
Adetunji ordered that the sureties must be gainfully employed and must produce evidence of two years tax payment to the Lagos State Government and have their addresses verified by the court.
She ordered that the sureties must reside within the court’s jurisdiction and be related to the defendant by blood.
The magistrate adjourned the case until June 7 for mention.
